Rental Agreement

This is the rental agreement that every direct-booking guest acknowledges at checkout. The version applicable to your stay is the one in effect on the day you booked, and is also stored on your booking record for your reference.
1. Parties and property
This rental agreement is between the named guest (the "Guest") and Terrapin LLC, the owner of Terrapin Beach House at 34290 Ocean Dr, Pacific City, OR 97135 (the "Property"). The Guest is responsible for all members of their party for the duration of the stay.
2. Check-in and check-out
Check-in is no earlier than 4:00 PM local time on the arrival date. Check-out is no later than 10:00 AM local time on the departure date. Early arrival or late departure must be approved in writing by the owner.
3. Maximum guests
The Property sleeps up to 8 guests. The total number of overnight guests at the Property may not exceed this limit at any time. Day visitors are welcome but the overnight limit is a strict county regulation.
4. No pets, events, smoking, or vaping
Pets of any kind are not allowed on the Property. Parties, weddings, and other events are not allowed pursuant to county regulations. Smoking and vaping, are not allowed anywhere on the Property — inside or outside. Violation of these rules will result in immediate termination of the stay without refund and may incur additional cleaning or remediation fees.
5. Recording devices
Exterior security cameras above each deck door are TURNED OFF during stays. A Ring doorbell at the front entry is always on and records the entryway and driveway. There are no cameras of any kind inside the home. By signing, the Guest acknowledges this disclosure as required under Oregon law.
6. Beach fires and quiet hours
Beach campfires are permitted under Pacific City rules: small fires on the open beach below the dune, never unattended, fully extinguished before the Guest leaves the area. No fires in the dunes. Quiet hours under Pacific City ordinance are 10:00 PM to 8:00 AM.
7. Cancellation policy
The Guest may cancel under the following schedule, measured from the check-in date in the Property's local time zone: 30 or more days in advance — 100% of nightly and cleaning fees refunded; 7 to 29 days in advance — 50% of nightly fees plus 100% of cleaning fee refunded; 0 to 6 days in advance — no refund. Lodging tax is refunded in proportion to the refunded amount. Refunds are issued via the original payment method when possible.
8. Damage and liability
The Guest agrees to leave the Property in the same condition as they found it, allowing for normal wear and tear. The Guest is liable for any damage to the Property or its contents caused by the Guest or any member of their party during the stay. The owner is not liable for personal injury, lost property, or any incidental or consequential damages arising from the Guest's stay, except where prohibited by law.
9. Governing law
This agreement is governed by the laws of the State of Oregon. Any dispute arising under this agreement will be resolved in the courts of Multnomah County, Oregon.
10. STVR permit
Terrapin Beach House operates under Tillamook County Short-Term Vacation Rental permit 851-18-000072-STVR.
